Important information on pre-emption rights!
On 1 January 2023, the new Law on Local Self-Government came into force, which no longer includes the institution of the right of pre-emption of local governments.
What does this mean for property owners who own land (land for private house construction, land already developed, agricultural land (with some exceptions)) when selling these properties?
This means that the municipality no longer has to ask for a waiver of the right of first refusal once the contract of sale has been concluded, in order to sell to an interested buyer and successfully register the property in the Land Register in the name of the buyer.
