"Debt follows the apartment" - what do buyers need to know from 2026?

The Saeima has adopted significant amendments to the Law on Apartment Property, which will enter into force on 1 January 2026.

From now on, a new principle will apply:
👉 Debts will "travel with" the property.

What does this mean for the buyer?
🧾 If you buy or receive an apartment as a gift, you become liable for debts relating to:
- house management
- utility bills
- savings fund
- land charges

📆 Debts can be up to 3 years old and must be paid immediately after the transaction. Interest and penalties, if any, must also be paid.

☝️ Older debts will remain the responsibility of the previous owner. If the apartment has been forcibly repossessed, the previous owner remains liable.

How can I protect myself?
✔ Ask for a statement of payment obligations before signing the contract
✔ The seller can obtain the certificate on e-parvaldnieks.lv or in person
✔ The buyer must ask the seller directly for this information - the manager must not provide it to third parties
✔ The buyer can challenge the debt in court if it was not justified in the first place
✔ The debt can be enforced against the seller in court, with exceptions such as agreeing to reduce the sale price of the apartment by the amount of the debt.
